A solid foundation in alternative dispute resolution principles will contribute to a successful ADR practice. Learn what the court decision in Alfieri means and its impact on your liability to your client in a mediation, as well as how to avoid a malpractice claim. Discover what pro bono opportunities exist in court-annexed arbitration and mediation and if an ADR business model can be combined with your legal practice. Find out what organizations, panels, and experience will build your ADR credibility and how to get selected for ADR work. End the day with a discussion on closing the deal.

The Foundations of Negotiation
by: Professor Jennifer Reynolds
This course provides an overview of foundational bargaining concepts, and is perfect for the first-time student of negotiation or for the experienced negotiator who is interested in more formal understanding of the practice. Among other topics, we will cover anchoring and the winner’s curse, one-time versus repeat play, and principal-agent tension. This course is designed to be the first course in a longer series of CLEs on negotiation skill development.
